Loops often run only a few hours, so a clip you don&#8217;t save tonight may be gone tomorrow. A missed follow up visit reads to the insurer as proof you got better.<\/p>\n\n    <h2 class=\"jal-h2\" id=\"jal-hardest\">What is the <em>hardest injury to prove<\/em> after a car accident?<\/h2>\n\n    <p><strong>The hardest injury to prove is the kind that doesn&#8217;t show up on a basic scan: soft tissue damage and whiplash, a concussion or traumatic brain injury, and pain and suffering itself.<\/strong> You prove these with the right imaging, steady medical treatment, a symptom journal, and the people close to you who can describe how you&#8217;ve changed since the crash.<\/p>\n\n    <p>Soft tissue injuries and whiplash barely register on the quick scan an emergency room runs, so an MRI is often what shows the strain or a torn disc. A concussion or brain injury can look fine from the outside, so a doctor&#8217;s notes on memory, headaches, and mood carry the case. Pain and suffering has no scan at all.<\/p>\n\n    <p>Three kinds of proof carry that weight: steady treatment with no gaps, a symptom journal, and the people close to you who knew you before the crash and can describe the difference now. The injuries hardest to prove are the ones where careful documentation matters most.<\/p>\n\n    <h3 class=\"jal-h3\">How to keep a symptom journal that proves pain<\/h3>\n\n    <p>Keep it simple and do it every day. Words are evidence too: the four sentences that hurt the most after a crash are &#8220;I&#8217;m sorry,&#8221; &#8220;I&#8217;m fine,&#8221; &#8220;I didn&#8217;t see them,&#8221; and &#8220;it was my fault,&#8221; and <a href=\"https:\/\/severeinjurylawyers.com\/what-not-to-say-to-a-car-accident-lawyer-texas\/\">what to hold back and who can hear it<\/a> is its own guide.<\/p>\n\n    <ul>\n      <li><strong>The car.<\/strong> Getting it fixed fast feels responsible, but a quick repair can wipe out the black box data and the physical proof. Photograph it thoroughly, then tell your lawyer before it&#8217;s repaired or released.<\/li>\n      <li><strong>Social media.<\/strong> A smiling photo or an &#8220;I&#8217;m fine&#8221; post gets saved and used to argue you weren&#8217;t hurt. Go quiet until the claim is done.<\/li>\n      <li><strong>Guessing out loud.<\/strong> Saying &#8220;it was probably my fault&#8221; answers the exact legal question the whole case turns on. A wrong guess can wipe out your claim.<\/li>\n    <\/ul>\n\n    <p>The recorded statement deserves its own warning, because you can say no to it. Careful words matter with them in a way they never do with your own lawyer, and there&#8217;s a whole list of lines that quietly hurt your claim once you know who you&#8217;re talking to.<\/p>\n\n    <h2 class=\"jal-h2\" id=\"jal-lawyer\">What a lawyer can <em>preserve<\/em> that you can&#8217;t reach<\/h2>\n\n    <p><strong>A lawyer can preserve evidence you have no way to reach on your own.<\/strong> A spoliation letter puts the other side on legal notice to stop destroying data. Subpoenas pull phone records and a commercial truck&#8217;s black box before any of it is erased. And accident reconstruction turns the physical evidence into a clear picture of fault. This part of the case runs hardest against the clock.<\/p>\n\n    <p>A spoliation letter is a formal notice to the other driver, their insurer, and any company involved. It puts them on the hook to hold the vehicle, the footage, the phone records, and a truck&#8217;s logging device. Destroy that evidence after the letter lands, and a court can punish it. Subpoenas reach what a letter can&#8217;t.<\/p>\n\n    <p><strong>If you suspect the other driver was on their phone, their carrier records show that phone&#8217;s activity to the minute, and it takes a lawyer&#8217;s subpoena or discovery request to reach them.<\/strong> Pair those records with the exact crash time and a witness who saw the driver looking down. That pairing turns a hunch into proof of fault.<\/p>\n\n    <p>When fault is disputed, an accident reconstruction engineer rebuilds the speeds and positions from the photos, the black box data, and the skid marks. None of this happens if you wait, and by the time you feel ready, the footage is often gone. Calling early is the difference between proof that exists and proof that used to.<\/p>\n\n    <p>Conditions have records too. That presumption can decide a case by itself.<\/p>\n\n    <p>The rule has two edges. A preservation letter locks in that duty for the other side, the trucking company, the store with the footage. Anything they erase afterward can cost them at trial. And you carry the same duty once a claim is foreseeable. So don&#8217;t scrap your own car, wipe your dashcam, or delete your posts without advice.
