A DWI is negligence per se, which means the driver’s violation of the law is built-in proof of fault, and your civil case only has to meet the lower “more likely than not” standard, not the criminal “beyond a reasonable doubt.” Under the Texas Dram Shop Act (Alcoholic Beverage Code § 2.02), a bar or restaurant that served an obviously intoxicated patron can be a second defendant with its own insurance. How long do I have to file a drunk driving accident claim in Texas?
Under Texas Civil Practice and Remedies Code § 16.003, you generally have two years from the crash to file suit, and the same two-year deadline applies to a dram-shop claim against a bar. A wrongful death claim runs two years from the date of death.
Do I need the driver to be convicted of DWI to win my case?
No. Your civil case only has to prove fault is “more likely than not,” a far lower bar than the criminal “beyond a reasonable doubt.” A DWI is also negligence per se, so the violation itself is built-in proof of fault. You can win your claim even if the criminal case ends in no conviction.
Can I sue the bar that over-served the driver?
Sometimes, yes.
