In Texas, you usually have just 2 years to file.

You have two years to file; but the truck’s data, logs, and footage can be erased within weeks. A government truck can cut that deadline to months. The sooner we start, the more proof we can lock down.

Why truck accident cases are different.

Dallas semi truck accident claim is not just a larger car accident case. Whether the vehicle was an 18 wheeler, tractor trailer, or box truck, commercial trucking cases are shaped by Federal Motor Carrier Safety Administration rules covering hours of service, driver qualifications, inspections, maintenance, cargo securement, and alcohol and drug testing, which creates evidence ordinary crash cases do not have.

That matters because the answer is not always just whether the driver was careless. A strong truck case often turns on whether the carrier pushed unrealistic schedules, kept an unsafe truck on the road, ignored driver fatigue, failed to train, or violated basic federal safety rules that existed to prevent exactly this kind of crash.

“Trucking cases are complex, it requires a tremendous amount of effort and legal knowledge to secure the correct evidence such as driver logs, data, inspection history, maintenance files, and dispatch communications. It is the difference between winning and losing a case, it is important to start early and get the jump.”

Your options after a Dallas truck crash.

Handle it yourself.

If the crash was minor with no injuries, you can deal with the insurer directly. However, lawsuits involving truck accidents are rarely simple, and an injury that seems small can turn into a serious medical problem weeks later. We have seen that happen more often than we’d like to count.

1 Maybe fine if
Minor crashNo injuriesNo lasting pain

Take the early offer and sign.

You can accept the insurance company’s first check, but signing will prevent you from ever filing a lawsuit. In truck cases you are dealing with insurance policies that can be worth in the multi millions. It is always best to speak to attorneys who have direct experience with trucking cases such as the J. Alexander Law Firm in Dallas.

Hire a firm that knows truck cases.

As Dallas semi accident lawyers, we collect evidence faster than Speedy Gonzalez; this matters because as mentioned before evidence can get lost between the cracks. You also need to keep in mind that there are federal safety rules that determine how shared blame is argued because the insurance company will 100% blame as much as they can on you. Our goal is to make sure that we hold the driver, company, maintenance shop, cargo loader and the truck manufacturer potentially liable for damages caused.

What we’d advise, and why you can trust it.

What we recommend

Figuring out who is the claimant, the timeframe, and the accident details are crucial in determining whether or not you have a case. Talk to us before you sign anything or give a recorded statement. A free case review costs you nothing and gives you the knowledge you need to make proper decisions.

Why you can trust that advice:

We have the results, reviews, awards and sponsorships as well as a $15M recovery for a family after a fatal 18 wheeler collision and recovering over 100 million dollars from mostly insurance companies. We have hundreds of cases, settlements and verdicts across Texas.

Inside knowledge.

Our star attorney Matthew Graham spent over a decade directing insurance defense litigation across a 10 state region for the country’s second largest auto insurer. He knows exactly how the other side operates and how they fight a lawsuit from a trucking accident.

How we’d build your case

A truck case becomes a slam dunk when you prove the company knew better and did it anyway, because that is what unlocks punitive damages and makes a carrier pay full value. So we dig deeper: the driver’s record before they hired him, the company’s safety violations and prior crashes, the pay structure that rewarded speeding, the dispatch texts pushing him past his limit. Then with that kind of proof they tend to admit fault; So the driver facing dashcam, his phone records, fuel receipts, potential falsified logs are all recorded as evidence in your case.

Jackknife crashes

There are many reasons jackknife accidents happen; sudden braking, wet streets, overloaded cargo or speed. We make sure once we get the case to review braking data, footage and driver logs.

Underride crashes

Unfortunately what tends to happen in this kind of accident is that the car will slide under the trailer; causing significant injuries to the driver, passenger and vehicle.

Wide turn crashes

When a truck driver, for example, turns into a left lane then goes right, what usually ends up happening is that the truck will pin a vehicle against medians, curbs or barriers.

Rear end semi truck crashes

Trucks do not break as cars, it takes longer; delayed braking, distraction, fatigue or following too close can cause these kinds of accidents.

Cargo shift and cargo spill crashes

Improper securement and overloading are the usual culprits for roll over accidents, this can cause debris on the road and cause pileups and or injure multiple people.

Hazmat truck crashes

Hazmat trucks can carry combustible and dangerous liquids which in an accident can cause explosions and fire. Typically with these there are multiple liability claims.

What Dallas drivers ask us about truck accidents.

What makes a truck accident claim different in Texas?
Here’s what actually makes them different: a car wreck usually comes down to one driver and one insurance policy. A truck is run by a company, and federal safety rules force that company to keep a paper trail driving logs, onboard data, maintenance and hiring files; that can put the crash on the company itself, not just the driver. More defendants means more insurance to recover from, which is why a serious truck claim is usually worth far more than a car accident.
Who can be held liable after a Dallas truck accident?
Usually the driver’s insurance can’t cover a catastrophic injury. The real money is everyone else: the company that hired him, the company, the loader, the manufacturer. Each is another policy; and they blame each other to survive, which proves your case for you.
Can I still recover if I was partly at fault?
Texas lets you recover as long as you’re not more than 50% at fault. But here’s what the insurer won’t say: every percentage point of blame it pins on you comes straight off your check, and past 50% you get nothing. That’s why they work so hard to push fault onto you. Don’t hand them the ammunition.
How long do I have to sue after a truck accident in Texas?
Usually two years; but that number is dangerously reassuring. You have two years to file; you have weeks before the truck’s data, logs, and footage can be erased. By the time most people lean on that deadline, the proof is already gone. And a government truck can cut the deadline to months.
What if the trucking company destroyed evidence?
Counterintuitively, it can become one of your best weapons. If a company destroys evidence it was legally told to preserve, a jury can be instructed to assume it would have buried them; so the destruction itself helps prove your case.
