An empty rural Texas highway at dusk with soft shoulders, where most single vehicle rollovers happen

Our Dallas rollover accident lawyers move quickly to preserve the vehicle, inspect the crash scene, and investigate what caused the rollover. In a single vehicle crash, the insurance company may assume the driver was at fault. We look for the evidence that explains what really happened.

Why the first days matter

A rollover accident can destroy important evidence within days. A rolled over car may be declared a total loss and sent to a salvage yard, the tires may be discarded, and physical evidence at the crash scene may disappear after rain, traffic, or road work. Whether the car rolls over on a high speed ramp or a rural shoulder, that physical proof fades first.

US 75
rollover before sunrise, June 2026

A two vehicle crash on US 75 flipped one vehicle onto the shoulder at Mockingbird Lane shortly after 4:30 a.m., sent one person to the hospital, and closed every northbound lane while crews cleared the road.

Three documented rollover scenes from Dallas traffic reporting: WFAA and CBS Texas coverage of the interchange truck rollovers, CBS DFW on the Saner Avenue ramp crash, and TxDOT reported closures at Mockingbird Lane. These are public incidents, not firm cases. All three sit on ramps or at exits, the geometry this page is about.

What causes a rollover accident in Dallas?

A rollover occurs when a vehicle goes onto its side or roof. Many single vehicle rollovers happen when the vehicle leaves its path and one or more tires strike something that causes the vehicle to tip or rotate. This is often called a “tripped” rollover.

For example, a tire may drop off the pavement edge onto a soft shoulder. The tires can slow or stop while the upper part of the vehicle continues moving, causing the vehicle to pivot and roll.

Common rollover causes

  • A tire dropping onto a soft shoulder or pavement edge drop off
  • A curb, ditch, slope, or road defect that causes the vehicle to trip
  • A tire blowout or tread separation
  • A sudden swerve to avoid another vehicle
  • Unsafe road conditions, including an unmarked drop off or washout
  • Excessive speed or unsafe steering while entering a curve
  • Vehicle design or stability issues involving SUVs, pickups, vans, and other taller vehicles

The cause of the crash may determine who is responsible. Depending on the facts, a claim may involve another driver, a tire manufacturer, a vehicle manufacturer, a contractor, or the party responsible for maintaining the roadway.

Evidence we look for in Dallas rollovers.

A rollover is not always simply a case of “losing control.” That is an explanation insurance companies may use, but it is not necessarily the full story. We investigate four key issues, and each one can name a different party to answer for the crash.

Before accepting the insurance company’s explanation, make sure the evidence has been reviewed; preserved evidence is what keeps your share of fault below the recovery bar. The first consultation is free.

1

The trip point

We inspect the area where the vehicle left its path.

Tire marks, gouges, shoulder damage, pavement edge drop offs, curbs, ditches, and road defects may help explain how the rollover started. Tell us what you noticed before your car rolled over, a pull, a drop, a bang, or another vehicle crowding you off the road.

2

The tires

A tire failure can cause a driver to lose control before a rollover begins.

The tire itself, along with available vehicle data, may help determine whether the failure occurred before or during the crash, and a tire that failed on its own can implicate its manufacturer.

3

Another driver

Another driver may be responsible even if there was no physical contact.

A driver who cuts you off, forces you to swerve, runs you off the road, or leaves the scene may still be liable. A distracted, drowsy, or drunk driver can start a rollover without ever touching your vehicle.

4

The roadway

Unsafe road conditions may contribute to a rollover.

A dangerous shoulder, unmarked drop off, road defect, construction hazard, or poor maintenance issue may create a claim against a government entity, contractor, or another responsible party.

From the other side

How insurers handle single vehicle rollover claims.

Insurance companies may begin a single vehicle claim with the assumption that the driver made an error. An adjuster may ask for a recorded statement, request an estimate of your speed, or ask you to describe the crash before the evidence has been reviewed.

What to watch for

Be careful. A statement such as “I lost control” may later be used as an admission of fault, even if the crash involved a failed tire, unsafe road condition, or another driver, and a quick admission can erase that other driver from the story entirely, when naming them is exactly what lowers your share of fault.

A pushed admission matters because, under Texas proportionate responsibility law, your compensation can be reduced by your percentage of fault. If you are found more than 50 percent responsible, you may be barred from recovering damages.

Matthew Graham, our Managing Litigation Attorney, spent more than 10 years directing insurance defense litigation. He understands how insurance companies investigate and evaluate these claims and helps our team prepare for the arguments they may raise.

What the carrier rarely volunteers: your own policy may pay parts of the claim, a detailed statement can wait until you have prepared with counsel, and the first offer tends to arrive before anyone has read the evidence.

CoverageIs a rollover covered by collision insurance? Why your own collision coverage applies with no other car

Usually, yes. Many Texas auto policies define collision coverage to include an “upset” of the covered vehicle. That means your collision coverage may help repair or replace your vehicle even if no other car was involved.

Every policy is different. Review your policy and declarations page before accepting a total loss offer or settling the vehicle claim.

The recorded callWhat should I say in a recorded statement? The words adjusters wait for, and the safer script to follow

Report the crash to your insurance company promptly, but keep the initial report brief and factual. Provide the date, location, vehicles involved, and the name of the storage yard holding your vehicle. Keep anything beyond those basics for after you have prepared with us.

Data from the vehicle’s event data recorder can be more reliable than a rushed estimate made after a traumatic crash; it answers the adjuster’s speed question with numbers instead of guesses, so preserving that data before giving a detailed statement matters. The fast total loss serves the carrier twice, closing the file and removing the evidence with it, and the first offer usually prices your urgency rather than your claim.

Coverage layersWhat coverage may applyCollision, PIP, MedPay, and uninsured motorist, depending on your policy

Collision coverage may pay to repair or replace your vehicle. PIP may help pay medical expenses and part of lost income, regardless of fault. MedPay may help pay accident related medical expenses, regardless of fault. Uninsured motorist coverage may apply if an unidentified or uninsured driver forced you off the road.

These coverages fund the early medical bills from the injuries while fault is still being argued, and which ones apply depends on your policy and the circumstances of the crash.

Damages and the deadlineWhat a Dallas rollover claim can recoverThe damage categories, and the two year clock that caps them

A rollover accident claim may include compensation for medical bills and future medical treatment, lost income and reduced earning capacity, pain and suffering, mental anguish and physical impairment, and vehicle repairs, total loss value, and other property damage. The injuries drive the medical side of that list.

If another driver acted with gross negligence, for example while intoxicated or street racing, additional damages may be available in some cases. A product defendant can expand these damages as well, and claims involving public entities or roadway conditions carry special notice requirements much shorter than the general lawsuit deadline, so a roadway claim starts its clock almost immediately.

Texas generally allows two years from the date of the crash to file a personal injury lawsuit (Tex. Civ. Prac. & Rem. Code § 16.003), and a fatal rollover expands the claim into a wrongful death case for the surviving family, with its own deadline based on the date of death. Those clocks are why the preservation work starts the same week.

How we build a rollover injury case.

Rollover cases require quick action because evidence often disappears before the insurance claim is fully developed.

  1. Preserve the evidence. We send preservation letters to the insurance company, storage yard, towing company, and other parties who may control the vehicle or its parts. These letters request that the vehicle, tires, and available electronic data be preserved. The event data recorder holds speed, braking, and steering from the final seconds.
  2. Document the crash scene. We photograph and inspect the roadway, shoulder, curbs, ditches, debris, tire marks, and other physical evidence that may explain why the vehicle rolled.
  3. Determine the cause. We evaluate all potential causes, including another driver, a tire failure, vehicle behavior, roadway conditions, and comparative fault. When necessary, accident reconstruction experts read the physical evidence at the trip point and interpret the vehicle data from the recorder. The cause helps determine which person, company, or government entity may be responsible.

Bring your crash report number and the storage yard’s name to your consultation. We may be able to begin preserving evidence the same day.

Questions we hear after a rollover.

Who pays my medical bills if the insurer blames me for a rollover in Dallas?

Your PIP or MedPay coverage may help pay medical expenses regardless of who caused the crash. These benefits can be important while the insurance company investigates fault.

What does it mean when a Dallas rollover is called tripped?

Many rollover accidents are tripped rollovers. This means the vehicle left its intended path and struck a curb, ditch, pavement edge, soft shoulder, slope, or other obstacle that caused it to tip.

On Dallas corridors like I 35E and US 75, that trip point is often a ramp curb, a soft shoulder, or a pavement edge drop off. Finding the trip point can help determine whether another driver, a defective tire, an unsafe road condition, or another factor contributed to the crash.

The insurer says I lost control on a Dallas highway. Can they assume that?

A single vehicle accident does not automatically mean the driver was at fault. Responsibility depends on the evidence.

A Dallas police crash report may list a contributing factor, and that entry records an officer’s opinion rather than a legal finding of fault. A road defect, tire failure, vehicle defect, another driver, or unsafe roadway condition may have contributed to the crash. Texas law generally reduces a person’s recovery by their percentage of fault and may bar recovery when their responsibility exceeds 50 percent.

What vehicles are more likely to roll over on Dallas highways?

Taller and narrower vehicles, including many SUVs, pickups, and vans, may be more susceptible to rollovers because they have a higher center of gravity than many passenger cars, so a smaller trip can start them over. The connector ramps between I 35E and I 635 pair a curve with a speed change, which is where that higher center of gravity shows up.

That does not prove the vehicle was defective or that the driver caused the crash, though when the evidence does show a stability defect, the claim can reach the manufacturer. The vehicle, road conditions, speed, steering input, tires, and crash evidence should all be evaluated. A higher center of gravity also helps explain why rollovers carry an outsized share of occupant deaths.

Can you survive a rollover accident in Dallas?

Many people survive rollover accidents, and no honest percentage exists for the odds or the chances, so treat any exact figure with suspicion. The verified numbers explain the fear: rollovers are uncommon, only a few percent of all crashes, yet they carried 28 percent of passenger vehicle occupant deaths in 2023, per NHTSA. A car rolling over throws everything inside around, and the common injuries are head and brain trauma, spinal and neck injuries, broken bones in the arms and shoulders, and cuts from shattered glass, with ejection the worst outcome, which is why wearing a seat belt matters most; it keeps occupants inside the vehicle during the rollover.

If a rollover caused a fatal injury, surviving family members may have a wrongful death claim. These claims involve separate legal requirements and deadlines.

How much does a Dallas rollover accident lawyer cost?

There are no upfront costs. We advance case expenses, and our attorney fee is a percentage of any recovery.

The fee is typically about one third if a claim settles and may be closer to 40 percent if litigation is required. The exact fee arrangement will be explained in writing before representation begins, and you owe no attorney fee if there is no recovery. On timing, clearing the crash itself is quick, lanes usually reopen within hours; the claim is the part that takes months.

Still have questions? The fastest answers come from a quick, free call with an attorney who can hear your specific situation.
