A few wrong assumptions quietly cost people their cases. Here is the difference between what feels true and what the law says.

The myth

“I walked away, so I was not really hurt.”

The reality

Concussions, whiplash, and internal injuries often hide for hours or days. The medical record from an early visit is frequently what proves the claim.

The myth

“The wreck was partly my fault, so I get nothing.”

The reality

Under Texas personal injury law, fault follows proportionate responsibility. If you are 50% or less at fault, you can still recover, but your award drops by your share; if an adjuster pins 20% on you, your recovery falls by that same 20%. That percentage is not a fixed number the adjuster controls; it is an argument, and we dispute it with the crash report, witnesses, and accident reconstruction before it gets locked in. Keeping your share of the blame as low as possible is one of the most valuable things we do. The myth

“The other driver had no insurance, so I am out of luck.”

The reality

Whether an uninsured driver rear-ends you or a hit-and-run leaves no one to sue, your injuries are just as real and just as compensable. You can file an uninsured or underinsured motorist claim directly with your own insurer; it can fund the same compensable damages, from hospital bills and lost income to pain and suffering, and it follows the same path as any other car accident claim: we investigate, document your damages, negotiate, and litigate if the offer falls short. What a claim can cover

The two halves of what you are owed.

Texas personal injury law defines two tracks of compensation: economic damages you can add up, and non-economic damages no receipt can capture. An adjuster attacks both in sequence; first the hard numbers, then the losses without receipts. Their sharpest lever is Texas proportionate responsibility: every point of fault an adjuster pins on you cuts your economic damages by exactly that percentage. A fair settlement accounts for both tracks; a quick offer rarely does.
