In Texas, you generally have two years from the injury to file (Texas Civil Practice and Remedies Code § 16.003), and fault is shared under a modified comparative negligence rule that bars recovery only if you are more than half at fault. Unlike medical malpractice, an ordinary negligence case, a crash, a fall, a workplace injury, carries no cap on the compensatory damages a jury can award for future medical care, lost earnings, or pain.
