What Can Complicate a T-Bone Accident Claim.

After a T-bone crash, both drivers may believe that they have the right-of-way. The question we ask ourselves is what happened in the seconds before impact: who had the green light, who was turning, who was entering from a driveway, who failed to yield, or whether another vehicle affected the intersection.

The Crash Report.

A crash report, from our experience, is what the officer sees and what information is available at the scene. If you were injured, taken to the hospital, or unable to give a complete account, the report may not include every detail you remember.

That does not mean the report is wrong. Taking the report into account along with photos, vehicle damage, witnesses, video, and other evidence is what is important.

Insurance Calling.

Per our attorneys, it may take up to 14 days for Fort Worth crash reports to become searchable through TxDOT's CRIS system, so adjusters may contact you soon after the crash and ask for a recorded statement before you have seen the report or know what evidence is available.

You can provide basic identifying information, but you do not have to give a recorded statement before you understand your options.

Evidence Disappearing.

Gas stations, restaurants, apartment complexes, and houses have all been sources of evidence in our cases. Owners of private camera systems are sometimes surprised when we call them; many do not know their footage can be used to prove an accident.

We always look at the location, identify probable video sources, and send preservation requests when necessary. We use those legal requests to determine if relevant footage still exists before anything is deleted.

How Much Does It Cost to Hire You?

What Actually Comes Out of a Settlement?

The settlement number is not the number you take home. Medical providers and health plans may be entitled to reimbursement out of a recovery, and those payments come off before you receive compensation.

What If Both Drivers Say the Light Was Green?

Then only the evidence can settle the issue, not the two accounts. In that situation, moving early matters most.

Nearby video, signal timing data, the location of each vehicle, the scattering of debris, lane positions, and anyone who stopped at the scene can all help show who had the right of way.

How Do I Find Crash Video?

Gas stations, restaurants, apartment buildings, homes, and other vehicles on the street may have a camera facing the intersection. No Texas law requires private owners to retain footage, and most systems automatically discard the oldest files.

Write down every business near that intersection and bring the list to your first call.

How Do I Get My Fort Worth Crash Report?

FWPD directs crash report requests through TxDOT's CRIS system. A crash report may take up to 14 days after the crash date to become searchable. If it is not available after 14 days, contact the FWPD Police Records Unit at 817-392-4160.

If you have the report but do not understand the codes, call us and we can review it with you.

How Long Do I Have to File?

A Texas injury lawsuit generally must be filed within two years of when the claim accrues, and certain circumstances, including some claims involving government entities, carry a shorter deadline.

Practically, the deadline is much earlier, since footage can be gone long before the legal deadline expires.
