Head-On Claims Require a Coverage Review

Texas liability coverage is limited. Hospital care, surgery, rehabilitation, missed work, and vehicle damage after a head-on collision can exceed the at fault driver's available policy limits. If the driver was uninsured or cannot be identified, there may be no liability coverage for that driver at all.

Your Own Policy May Matter

Texas auto policies generally include uninsured/underinsured motorist coverage unless a named insured rejects that coverage in writing. Whether it applies depends on the policy, available limits, the crash facts, and any valid written rejection. A policy review does not guarantee coverage. It gives you the information needed before signing a release.

You may receive an early settlement offer before you are aware of the extent of your injuries. A serious crash can result in headaches, dizziness, pain, memory problems, sleep disruption, anxiety, grief, or fear of riding in a car. It is common for a settlement check to come with a release. If you sign it, you may lose the right to sue the driver and their insurer for more money, even if your symptoms worsen or new treatment is needed later.

Every Policy Is Read Before Signing

In the other driver's case, the policy is at the beginning, not at the end. The review can include liability coverage, uninsured motorist coverage, underinsured motorist coverage, PIP, MedPay, vehicle owner coverage, and employer or commercial coverage. When the facts support it, the review can also include whether alcohol service in a bar or restaurant is part of the claim.

Not every coverage layer applies everywhere. The review happens before a release is signed and before anyone concludes that there is "no coverage."

The Evidence Gets Preserved Early

After representation begins, letters of representation go to the insurers involved. Crash reports, video, vehicle data, witnesses, DWI records where applicable, policy information, medical records, and wage loss documentation are requested before they become difficult to obtain.

Your case should reflect what the collision actually did: treatment, future care, missed work, and daily life. Tell your providers about each and every symptom as it appears. Accurate beats dramatic.

Practical Details Get Handled

The vehicle claim is separate from the injury claim. No percentage is taken from property damage or rental payments. If you do not have health insurance, treatment may be available under a Letter of Protection. It is not free care; medical charges are paid from recovery.

A named case manager provides a direct number and updates every 14 days. Home, hospital, and video meetings are available if injuries make travel difficult.

The Fees Are Stated Up Front

The fee is 33 1/3% of gross recovery before a lawsuit is filed and 40% after a suit is filed, plus a $300 administrative fee. Case expenses are separate, advanced by the firm, and reimbursed only after recovery.

Before accepting a settlement, you should see the gross offer, attorney's fee, case expenses, medical bills and liens, negotiated reductions, and estimated net recovery.

Litigation Is an Option

Some head-on collision claims are resolved without litigation. Others require litigation because the injuries are serious, liability is disputed, coverage is contested, or an underinsured motorist carrier does not fairly evaluate the claim.

Without a clear understanding of the policies and injuries, no settlement value can be promised. No one pressures you to sign a release while your condition changes.
