Fault and insurance
Will my own insurance pay if an uninsured driver hits me?
The short answer
It can. Matthew Graham, our managing litigation attorney, notes in his 2026 video that the uninsured and underinsured motorist protection on your own policy can compensate you for injuries from a hit and run or from a driver with no liability insurance, so such a crash is not always the end of the road.
“oftentimes what people don't realize is that their own insurance may cover their injuries.”
Key points from Matthew
Texas requires motorists to carry minimum insurance, yet some people hit by an uninsured driver think they have reached the end of the road, and sometimes that is true.
Coverage for uninsured and underinsured drivers on your own policy applies when a hit and run driver, or one who stayed but had no liability insurance, injures you.
Liability coverage is what the state requires to protect other people from the things we might do wrong, and it is what you hope the other car has.
Carrying collision, comprehensive and uninsured driver protection matters around DFW, where many drivers on the road have no insurance.
Reading your policy before a crash happens
The attorney begins with what clients tell us after a wreck with an uninsured driver. Many feel stuck, convinced nothing can be done, and he admits that is sometimes the case. His point is that people overlook a second source of payment, which is the coverage they bought for themselves.
He separates two kinds of coverage. Liability protects other people from what you might do wrong, and Texas requires it, so you hope the other car carries it. The uninsured and underinsured motorist kind protects you, covering a hit and run or a driver who stayed but held no liability policy. Collision and comprehensive sit beside it.
