Fault and insurance
The short answer
Yes, because the other party's insurance sets how much you can recover. Our managing litigation attorney, Matthew Graham, uses a 2026 video to explain that a company car or a truck usually carries larger limits than a typical personal auto policy, and that knowing those rules early helps a claim.
“The most important thing about your new car accident case is who hit you.”
How much a person hurt in a Texas crash can recover depends on the insurance carried by whoever caused it.
Private personal auto policies in Texas must carry at least $30,000 per person and $60,000 per accident, according to Matthew Graham.
A commercial driver such as a trucking company, grocery store, or traveling salesman in a company car likely has much higher limits.
A Texas intrastate trucking company is required to have at least half a million dollars of liability coverage, he says.
Matthew Graham opens by calling the question of who hit you the most important part of a new case, and he knows it sounds odd. The reason is simple. What an injured person can recover in Texas follows the insurance held by whoever caused the crash, so the same injuries can lead to very different outcomes.
He contrasts a private driver with a business vehicle. A company car, a grocery store or a traveling salesman likely carries limits well above the personal minimum, and some are set by law. He also says a good lawyer reads how the crash happened and can guess the coverage, the carrier and its adjusters.
