What to do right after a San Antonio motorcycle crash.

  1. Get out of the lane if you can, check yourself and anyone else for injuries, and call 911.
  2. See a doctor even if you feel okay; adrenaline can mask a rider’s injuries for days.
  3. Photograph the bike, the other vehicle, the plates, the road, and any skid marks.
  4. Collect the driver’s name, license, insurance, and plate, plus the names of anyone who saw it.
  5. Do not apologize, guess at fault, or tell anyone you are fine.
  6. Say nothing recorded to the driver’s insurer until you have talked to a lawyer.

Already left the scene? You can still act. Talk to us free.

Know this before you settle a motorcycle claim.

Not sure where your claim stands? Get a free case review; you pay nothing unless we win.

How long you have to file

Texas gives you two years from the date of the wreck to file suit; that is the statute of limitations. The filing clock is not the only one ticking, though. Camera footage at the intersection gets recorded over and witnesses forget long before two years are up, so the proof your claim rests on has to be secured right away; a free case review is how we start locking it down before it is gone. A government vehicle, like a VIA bus, or an injured minor can move the deadline either way, so a free case review today lets an attorney weigh your claim while the window is still open.

If you were partly at fault

Texas uses proportionate responsibility, and it starts with how the crash happened. A driver who turns left across your path is mostly at fault; but if their adjuster claims you were speeding, even a 30% share cuts a $100,000 recovery to $70,000, and once your share passes 51%, you collect nothing at all. Riders draw more of that blame than anyone, which is why we fight fault as hard as the injuries, with the signal timing, the footage, and the facts.

If the other driver had no insurance

Far too many San Antonio drivers carry no coverage, or nowhere near enough. When the driver who hit you cannot pay, the uninsured/underinsured motorist (UM/UIM) part of your own policy becomes a direct source of compensation for your medical bills and lost wages; but your own carrier still puts an adjuster on it whose job is to pay as little as possible, which is exactly why our oversight matters here too.

What actually proves your claim

Claims are won on evidence: the crash report, photos, your medical records, witness accounts, and any intersection or dashcam video. After a serious wreck, the other vehicle’s black box can show its speed and braking. We move quickly, because this proof does not wait around.

How long a case takes

Some claims wrap up in a few months. Cases with serious injuries, a fault fight, or a filed lawsuit can run a year or more. We will not swap a fast check for a fair one; we keep you posted and push as hard as the facts allow.

Before you accept any offer

The adjuster on your file answers to the insurance company, not to you. Their job is to close your motorcycle claim for as little as possible; that is exactly why a personal injury lawyer in your corner changes how this ends.

For years I ran insurance defense, so I know how carriers treat a motorcycle claim: blame the rider, then open far below its worth. That first offer is almost never fair. I learned the playbook from the inside, and now I use it for you.

How most San Antonio motorcycle crashes happen.

Left-turn crash

A driver turns left across your path and never sees you; the most common way riders get hurt. We pull the signal timing and nearby camera footage to show who had the right of way.

Failure to yield

A driver pulls out of a side street or parking lot right in front of you. Two of three car-versus-motorcycle crashes happen because the driver ignored a rider’s right of way.

Intersection T-bone

Getting hit from the side at an intersection can be deadly. We gather video from nearby businesses and check signal timing so the true order of events reaches a jury.

Unsafe lane change

A driver drifts into your lane or your blind spot. On I-10, Loop 410, and I-35 it happens because they did not look; we lock down the evidence and show how it unfolded.

Speeding

A speeding driver has less time to react and hits far harder when they do. We chase down every factor that made the crash worse.

Distracted driver

A driver staring at a phone will not see a motorcycle in time. We move fast to lock down the phone records and the rest of the evidence.

No matter the cause, the burden is on us to prove it. Tell us what happened.

What the crash data says about riding in San Antonio.

These are not abstract numbers. TxDOT’s 2024 crash facts count 585 riders killed and more than 2,500 seriously injured across Texas, and 37% of the riders who died were not wearing a helmet. Bexar County sits near the top of that ledger.

2,500+

1 in 3

#2
Bexar County’s rank among Texas counties for motorcycle crashes

TxDOT crash records put Bexar County second in Texas for motorcycle crashes, with more than 700 wrecks and 29 riders killed in 2025, and San Antonio second among Texas cities. More than a third of the state’s fatal motorcycle crashes happen at intersections; the left turns and failure-to-yield collisions described above. The most seriously hurt riders in this region are treated at University Hospital, the area’s civilian Level I trauma center near our Northwest Side office. If that is where your crash took you or someone in your family, the records built there become the backbone of your claim, and we know how to put them to work.

The San Antonio roads that put riders most at risk.

Deadliest by volume

Loop 410

The deadliest stretch in the metro for riders. At highway speed, a driver who changes lanes without a mirror check can run a motorcycle off the road in a heartbeat. We pull the camera footage from that junction to prove the driver, not you, caused it.

Dense, fast traffic

Interstate 35

Dense and fast, with traffic that stops without warning. A driver who looks up too late rear-ends the rider ahead, and a motorcycle has no crumple zone to absorb it. We move fast to lock down the dashcam and traffic camera video before it is gone.

High-speed merges

Interstate 10

Heavy traffic at high speed, where drivers crossing lanes simply do not expect a motorcycle beside them. Most of these wrecks begin in a blind spot. We map the lane changes and pull the dashcam and traffic footage to show how it happened.

Growing suburbs

Loop 1604

As the suburbs spread, the turning traffic grows with them. A driver turns left across a rider’s path, or merges up to highway speed without a second look; left-turn collisions like these are the single most common way riders get hurt. We prove the driver failed to yield.

North-south corridor

US-281

The main run from downtown past the airport to Stone Oak, where traffic moves at highway speed and drivers cut across lanes late to catch their exits at the 410 and 1604 interchanges. A rider sitting in that blind spot has nowhere to go. We reconstruct the lane changes and pull the footage to show it.

Surface street

Culebra Road

San Antonio’s most dangerous surface street: seven lanes wide, crossing both loops, with sun glare and constant turning traffic that hide a motorcycle until it is too late. We work the lighting and the time of day to show exactly why the driver never saw you.

Busy intersections

Bandera Road

Bandera crams high speed and one busy intersection after another into a single road, the kind of setup that hides a rider in a turning driver’s blind spot. When a driver runs a light or fails to yield to a motorcycle here, we pin the fault where it belongs.

Common crash corridors, not a complete list. Current Bexar County crash data is public through the TxDOT Crash Records Information System (CRIS) at cris.txdot.gov; the road and facts of your case are what matter.

The injuries we see most after a San Antonio motorcycle crash.

The crash usually dictates the injury. A driver turning left or drifting across a lane at highway speed can leave a rider with a brain injury, broken bones, or worse. Those injuries are what drive the medical bills, the lost income, and the pain and suffering you can recover.

Road rash and skin loss

Sliding across pavement tears through gear and skin. Deep road rash can need scrubbing, grafts, and leaves lasting scars.

Broken bones

Arms, wrists, legs, and ribs break easily when a rider goes down. Many need surgery, hardware, and months to heal.

Back and spinal cord injuries

A damaged disc or spinal cord can mean chronic pain, lost movement, or paralysis; among the most costly injuries to live with.

Traumatic brain injury

A helmet helps, but a hard impact can still injure your brain; symptoms can surface days later.

Internal injuries

Bleeding or organ damage is not always visible at the scene. That is why we urge you to get checked, even when you feel fine.

Leg, foot, and nerve damage

Crushed legs and feet and nerve damage are common when a rider goes down, and can limit movement for life.

What a San Antonio motorcycle accident lawyer does for you.

A motorcycle claim is not a car claim on two wheels. From the first call, the adjuster is building a story about you: the rider was speeding, weaving, hard to see. The first job of a motorcycle accident attorney is tearing that story down with proof; the signal timing, the skid marks, the camera footage, the witness accounts, and the other vehicle’s black box data showing exactly what the driver was doing when they crossed your path.

The second job is proving what the crash took from you. Road rash that needs grafts, fractures held together with hardware, a brain injury that surfaces days later; these carry costs the first medical bill never shows. We work with your doctors, and with outside experts when the case calls for them, so the demand covers future surgeries, therapy, and the work you will miss; not just what has already been billed.

The whole adjuster playbook depends on a rider taking a quick, low number instead of fighting the bias. That gamble collapses against a firm that will actually go to court. Ours are trial lawyers, prepared to put your crash in front of a Bexar County jury, and the size of the offer tends to reflect it.

And it costs nothing to begin. We take motorcycle cases on contingency: no win, no fee, which puts your recovery and ours on exactly the same side.

The steps of a motorcycle accident lawsuit, explained.

The clock controls everything here: in Texas you have two years from the date of the crash to start this process, and once that window closes, no amount of evidence or documented damages can bring the claim back. Most cases never reach a courtroom, but every one is built as if it will. Here is how a case moves once it is filed.

Even the cases that settle, we build for trial. Talk to a San Antonio motorcycle lawyer; no fee unless we win.

  1. We file your lawsuit

We file in the right Texas court, usually Bexar County, and name the driver who hit you along with anyone else who shares the blame.

  2. The other side answers

The driver and their insurer answer back. Count on them to deny fault; it is routine, and we plan for it from day one.

  3. Discovery

Both sides hand over evidence. Discovery is the formal stage where documents, written questions, and records get traded to lock the facts in place.

  4. Depositions

Witnesses and the parties answer questions under oath, on the record. A deposition is sworn testimony taken before the trial begins.

  5. Mediation

Before a trial date is set, most Texas courts send both sides to a neutral mediator to try to settle. This comes after discovery, and it is the stage where the large majority of motorcycle cases end.

  6. Trial

If a fair offer still never comes, the case goes to a Bexar County jury that hears the evidence and decides who is at fault and what your losses are worth. Knowing we are ready to get here is what moves the insurer at mediation.

How most San Antonio motorcycle claims actually end: mediation.

Your evidence is the leverage

The crash report, scene photos, and medical records your attorney builds do double duty. They set the fault picture under proportionate responsibility so the blame is not shifted onto you, and they are the same file we would put before a Bexar County jury if it comes to that. That record is also what drives the insurer’s offer; the stronger your evidence, the more leverage you carry into mediation, and well-documented cases tend to settle faster and for more.

The number you take home

The settlement reached in mediation is the damages figure you actually recover, most often without a jury ever deciding it. The most serious injuries, a brain injury or a spinal fracture, push that figure highest, which is why complete medical documentation is what separates a fair settlement from a low one.

Why you are not there alone

Mediation is not a neutral meeting. The adjuster who lowballed you from day one shows up with experienced counsel, still working to pay as little as possible, while your San Antonio motorcycle accident lawyer sits across from them, presenting your evidence, countering the lowball offers, and pushing for the full value of your damages.

Most claims end here

Worried about a long trial? Most motorcycle cases never get there. After discovery, Texas courts send both sides to mediation: a guided negotiation with a neutral mediator that often settles in a single day. It works because of what stands behind it; the adjuster offers fairly only when they know we are ready to take your case to a Bexar County jury, and if they refuse, that is exactly where we go.

Not sure whether to hire a lawyer?

Do you even need a lawyer?

If you went down with no injuries and only scratched the bike, maybe not, and we will say so on a free call. But riders walk away from “minor” wrecks with serious injuries, and adjusters offer the least to people on their own. If you were hurt or fault is in dispute, talk to someone before you sign a thing.

What our fee looks like

The first conversation is free, and you pay nothing out of pocket after it. We work on contingency: our fee is a set percentage of what we recover, written down before we begin, and owed only if we win. That fee comes out of the settlement, not your savings; no recovery means no attorney’s fee, and we front the costs of building the case.

How to choose the right one

Look for a firm that takes cases to trial instead of only settling, that picks up the phone, that has handled motorcycle wrecks like yours, and that explains your options in plain words. Ask who will actually work your file.

What to ask before you hire anyone

  • Who will handle my case day to day; you, or someone I have not met?
  • Have you taken motorcycle cases like mine to trial, not just settled them?
  • How is your fee structured, and what costs come out of my settlement?
  • What do you think my case is worth, and what could change that?
  • How, and how often, will you update me on my case?
  • What should I avoid doing while my claim is open?

What people get wrong after a San Antonio motorcycle crash.

Still have a question? Call (210) 901-6192 and ask us directly.

Not so. Texas does not bar your claim for riding without a helmet, and riders 21 and over with the required insurance or a safety course can ride legally without one. The insurer may raise it to shrink your payout; we push back and keep the focus on the driver who hit you.

That bias is exactly what insurers count on. Texas uses proportionate responsibility, so as long as you were 50% or less at fault you can still recover, with your award reduced by your share. We answer the blame with signal timing, camera footage, and the facts.

The adjuster works for the insurance company, not for you. Their first offer is almost always far below what your claim is worth, and represented riders typically recover more, even after fees.

You pay nothing up front. We work on contingency, so there is no fee unless we win, and we advance the costs of building your case. The consultation is always free.

Not true. Many serious injuries, including concussions, internal injuries, and soft-tissue damage, do not show up for hours or days. Get checked by a doctor and let us document everything from there.

In Texas you generally have two years from the date of the crash to file, but waiting hurts your case long before then. Cameras get overwritten and witnesses forget, so the sooner you call, the more we can preserve.
