We Collected the $30,000 Policy Limit for an El Paso Driver Cut Off by a Car Turning Right From a Stop Sign
A driver turning right from Roswell onto Gateway East, the I-10 access road in El Paso, failed to yield and ended up angled across our client’s lane.
The officer coded the failure to yield for her alone and cited her. Her insurer paid its full $30,000 limit before any lawsuit, and he had no underinsured motorist (UIM) coverage of his own.
Gateway East, One Right Turn From Roswell
Gateway East is a one way, three lane road beside I-10, posted at 45 mph. Our client was driving east in lane 1. The other driver came north on Roswell, a side street, and turned right onto Gateway East. This is how the officer wrote it up.
Unit 2 was traveling on lane #1 of 7200 Gateway East. Unit 1 was traveling north on 1900 Roswell. Unit 1 failed to yield the right of way when making a right turn from 1900 Roswell to 7200 Gateway East, colliding with Unit 2. Unit 2 operator complained of pain to the left side of his body, but refused transport to a medical facility. Both vehicles were privately towed. There were no witnesses reported.
Her car ended up angled across his lane. His front right corner hit her left rear quarter. The full police report is below, with names, plates, ID numbers and insurance details blacked out.
Open the redacted El Paso police report (PDF)No Witnesses, No Camera, One Stop Sign Factor Code
The report lists no witnesses, and no camera recorded the turn. The right turn case in our failure to yield accident guide was proven by a dash cam. This one had to be proven on paper.
The officer coded one contributing factor, code 35. The TxDOT code sheet defines it as a stop sign failure to yield. Only her car got that code, and she was cited for failing to yield. His diagram, marked “Not To Scale,” draws his car in the lane farthest from Roswell with hers angled into it. The damage on both cars fits that picture. These are the officer’s opinions, and a report alone does not decide fault.
Two Texas statutes cover this turn. A driver at a stop sign “shall yield the right-of-way to a vehicle that has entered the intersection from another highway or that is approaching so closely as to be an immediate hazard,” says § 545.153(b). A driver turning right must make “both the approach and the turn as closely as practicable to the right-hand curb or edge of the roadway,” says § 545.101(a). The diagram puts her car in the far lane instead.
Coded as an Evident Injury, He Refused the Ambulance
The officer coded his injury B, which the code sheet defines as “Evident injury such as bruises, abrasions, or minor lacerations which do not incapacitate.” He complained of left side pain but refused the ambulance.
He got himself to a freestanding emergency room that same afternoon. His head CT and his chest and pelvis X rays were normal, and he was diagnosed with a contusion, a bruise. His side curtain airbag had deployed, and a photo shows it. Follow up care for neck and low back pain lasted about three months, and he was released with a normal exam.
A $30,000 Limit and No UIM Coverage
The other driver carried a $30,000 policy, the Texas minimum per person, and her insurer paid all of it before any lawsuit. His own policy had no underinsured motorist coverage, so $30,000 was all the insurance money available.
In our DeSoto stop sign case, the other driver’s $30,000 limit paid in full and the client’s own $30,000 UIM limit paid too, $60,000 total. Here the limit was the end. We keep seeing bad accidents where the client has no UIM, and our guide covers at fault drivers with too little insurance.
Proving the Right Turn, Reaching the Full $30,000
How we reached this result, and what we offer every client.
Fault from the report alone
No witness, no camera. The case rested on the factor code, the citation, the diagram and the damage.
Every policy checked, no UIM found
Her limit was $30,000 and he had no UIM, so the goal was that full limit, paid before suit.

$30,000 Paid Before Any Lawsuit
$30,000
Full policy limit, paid before suit
The $30,000 is the gross amount, and he was paid after fees and costs were deducted. This result fits this case alone and predicts nothing about yours.
Check Your UIM Before the Next Accident
- Read your own auto policy and look for UIM coverage. Without it, a $30,000 limit may be all there is.
- If you turn down the ambulance, still get checked the same day.
- With no witnesses, the crash report carries the case. Order yours and read the factor code and the charges listed for each driver.
